KMK is delighted to report that it has obtained additional settlements of nearly $30 million in its longstanding price-fixing antitrust litigation on behalf of Wisconsin institutions. The additional settlements follow more than $20 million in settlements that KMK obtained in 2017, bringing all class action recoveries to date to roughly $50 million. The litigation continues as to four remaining defendant groups, with KMK pursuing additional recoveries from those entities.
After years of litigating the Wisconsin claims in multidistrict litigation proceedings in the federal court in Nevada, the case is now back to the federal district court in Madison, where it will be tried. KMK has moved the district court for a trial date so that, after 13 years of litigating the case, the fate of the remaining defendant groups can be placed in the hands of a Wisconsin jury.
The path to trial has not been an easy one. KMK had to fend off dozens of motions by the defendants intended to end the case. KMK won those battles. There have been six separate appeals to the United States Court of Appeals for the Ninth Circuit in San Francisco, and one appeal to the United States Supreme Court. KMK won all of those appeals.
