Replevin, also known as "claim and delivery", is an action to recover personal property that was wrongfully taken or detained. Unlike other forms of legal recovery, replevin seeks the return of the property itself, as opposed to its monetary equivalence. Complex laws govern the collateral recovery process and KMK attorneys have considerable experience representing equipment lessors, banks, secured creditors, and other lending institutions in this area. They have extensive knowledge of the Uniform Commercial Code (UCC) and state collateral recovery laws and have navigated nearly every possible situation while representing our business clients. In addition to real estate, personal property collateral is often included in commercial loans. Occasionally, business equipment may be the lender’s most valuable collateral. If a loan workout is not a viable option, KMK’s attorneys are experienced in recovering collateral through repossession and replevin and stand ready to do so to maximize your recovery. The sooner you contact us, the sooner we can get your matter resolved.
