Our consumer bankruptcy services and capabilities include cases filed under Chapters 7, 11, 12, and 13 of the United States Bankruptcy Code. Our objective is to protect our clients’ secured interests and rights in real property in all material respects relative to any bankruptcy issue or involvement.
We analyze each bankruptcy referral under the Bankruptcy Code, Rules, and case law. We evaluate the bankruptcy filing and schedules, our client’s accounting, and whether the filing of a proof of claim is required.
As with foreclosure, our bankruptcy practice focuses on improved recovery. We utilize Chapter 13 to collect arrearages and maintain post-petition monthly payments, all while providing adequate protection for our clients. We object to plans that do not adequately provide for our clients’ interests and we advocate against abusive, repeat filers.
