A trust is similar, yet different from a will. A trust requires a trustee or agent to act as the holder of the assets that are placed into the trust. The agent is at all times required to act in the best interests of the trust. The type of trust that should be used in the management of assets depends on the intent and ultimate goals of the trust creator. A trust that is meant to manage property that will go to beneficiaries may not be suitable for someone that wants to protect or grow assets.
KMKSC attorneys will meet with our clients and determine their goals and intentions. After listening to what the client wants to accomplish, we may recommend the creation of a trust, if it is in the client’s best interest. We will explain the benefits and make recommendations to our clients on the best course of action, and can provide guidance on the selection of the appropriate trustee or agent. KMKSC can also answer any questions our clients may have regarding the administration and disposition of the trust, and adjust the trust to the client’s specifications.
